These Terms of Service apply to your use of Totus AI chatbot and associated services. If you reside in the European Economic Area, Switzerland, or the UK, additional consumer protections may apply under local law.
By accessing and using Totus, an AI-powered chatbot service ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.
Our Privacy Policy explains how we collect and use personal information. Although it does not form part of these Terms, it is an important document that you should read.
Totus is an artificial intelligence chatbot designed to provide conversational assistance and information. The service uses advanced language models to generate responses based on user input.
You must be at least 13 years old or the minimum age required in your country to consent to use the Services. If you are under 18, you must have your parent or legal guardian's permission to use the Services.
You must provide accurate and complete information to register for an account. You may not share your account credentials or make your account available to anyone else and are responsible for all activities that occur under your account.
If you create an account using an email address owned by an organization, that account may be added to the organization's business account, in which case the organization's administrator may control your account.
You may provide input to the Services ("Input"), and receive output from the Services based on the Input ("Output"). Input and Output are collectively "Content." You are responsible for Content, including ensuring that it does not violate any applicable law or these Terms.
As between you and Totus, and to the extent permitted by applicable law, you (a) retain your ownership rights in Input and (b) own the Output. We hereby assign to you all our right, title, and interest, if any, in and to Output.
Due to the nature of AI services, output may not be unique and other users may receive similar output from our Services. Our assignment above does not extend to other users' output.
We may use Content to provide, maintain, develop, and improve our Services, comply with applicable law, enforce our terms and policies, and keep our Services safe. You can opt out of using your Content to train our models in your account settings.
Subject to your compliance with these Terms, you may access and use our Services. In using our Services, you must comply with all applicable laws.
You may not use our Services for any illegal, harmful, or abusive activity. For example, you may not:

If you purchase any Services, you will provide complete and accurate billing information, including a valid payment method. For paid subscriptions, we will automatically charge your payment method on each agreed-upon periodic renewal until you cancel.
We may change our prices from time to time. If we increase our subscription prices, we will give you at least 30 days' notice and any price increase will take effect on your next renewal.
You can cancel your paid subscription at any time. Payments are non-refundable, except where required by law. For EU consumers, you have a 14-day cooling-off period for purchases.
For organizations requiring enhanced liability protection, we offer a dedicated paid plan with increased liability coverage. Please contact us at contact@totus.org for more information about this enterprise-level protection.
We strive to maintain high availability of the Totus service, but we cannot guarantee uninterrupted access. The service may be temporarily unavailable due to maintenance, technical issues, or other factors beyond our control.
For EU consumers: We commit to provide the Services to you with reasonable skill and care and to act with professional diligence. We do not promise to offer the Services forever or in their current form for any particular period of time.
Totus is provided "as is" without warranties of any kind. Except to the extent prohibited by law, we make no warranties regarding the Services and disclaim all warranties including merchantability, fitness for a particular purpose, and non-infringement.
Neither we nor any of our affiliates or licensors will be liable for any indirect, incidental, special, consequential, or exemplary damages, including damages for loss of profits, goodwill, use, or data or other losses. Our aggregate liability under these Terms will not exceed the greater of the amount you paid for the Service that gave rise to the claim during the 12 months before the liability arose or one hundred dollars ($100).
Users on our Enhanced Liability Plan enjoy increased liability coverage as specified in their enterprise agreement. Contact contact@totus.org for details about enhanced protection options.
Some countries and states do not allow the disclaimer of certain warranties or the limitation of certain damages, so some or all of the terms above may not apply to you, and you may have additional rights.
You can stop using our Services and end your relationship with Totus at any time by closing your account.
We may suspend or terminate your access to our Services if we determine: you breached these Terms; we must do so to comply with the law; your use could cause risk or harm; or your account has been inactive for over a year without a paid subscription.
If we terminate your account, we will provide reasonable efforts to notify you in advance. If you believe we have suspended or terminated your account in error, you can file an appeal by contacting our support team.
If we have a dispute, we would first like to understand and try to address your concerns before any formal legal action. You can contact us through the channels provided in the application.
For US users, disputes will be resolved through final and binding arbitration. You may opt out of arbitration within 30 days of account creation. Class actions and jury trials are waived.
For EU and UK users, you can go to your local courts. EU residents can also raise disputes with an alternative dispute resolution body via the European Commission's Online Dispute Resolution (ODR) Platform.
We and our affiliates own all rights, title, and interest in and to the Services. You may only use our name and logo in accordance with our Brand Guidelines.
If you believe that your intellectual property rights have been infringed, please contact us. We may delete or disable content that we believe violates these Terms or is alleged to be infringing and will terminate accounts of repeat infringers where appropriate.
Our services may include third-party software, products, or services. Third Party Services and Third Party Output are subject to their own terms, and we are not responsible for them.
We may update these Terms or our Services from time to time due to changes in law, security reasons, new technologies, or service improvements. We will give you at least 30 days advance notice of changes that materially adversely impact you via email or in-product notification. Your continued use of the service constitutes acceptance of any modified terms.
For US users, California law governs these Terms. For EU/UK users, the law of your jurisdiction governs these Terms.
You must comply with all applicable trade laws, including sanctions and export control laws. Our Services may not be used in or for the benefit of embargoed countries or prohibited individuals/entities.
You may not assign or transfer any rights or obligations under these Terms. We may assign our rights to any affiliate or successor.
